Effects of DUI Accidents

Driving under the influence or DUI is often being defined as one attempting to operate any kind of vehicle who is intoxicated or under the influence of alcohol, drugs or both substances. No matter what kind of substance the person used which caused the offense, having this kind of crime opens a lot of possibilities to cause different damages such as extensive property damages and some serious injuries -even death. In most states, driving under the influence or driving while intoxicated (as termed in some states) is considered to be a misdemeanor. However, if there are some aggravating factors that are present or when the person already had multiple offenses for a specific period of time, there are still some changes that can be made. Aggravating factors may include the following: a child is present in the vehicle while the crime is being committed, there had been serious damages cause by the accident and having a BAC or blood alcohol content that is more than what the legal limit allows. In several states, there are several existing provisions in the DUI laws which allow the judges to enforce severe penalties for those offenders who have caused a lot of major bodily injuries which was a result of their driving under the influence. Some of those major bodily injuries include collapsed lungs, broken bone and other injuries which could result to a person being paralyzed. The increased sanctions give rise to the offenders to have longer terms in jail, longer periods of probation, increased financial penalties or fines, longer suspension of license and revocation periods and higher requirement demands for insurance and alcohol evaluation and treatment. The given increased penalties make the drivers to be more careful in driving and avoid driving under the influence. Having such sanctions keeps the streets safer from any injuries caused by DUI accidents.

There are some jurisdictions that have certain provisions of allowing the prosecutors to charge those drivers who have vehicular manslaughter as well as driving under the influence or driving while intoxicated if there are any fatal accidents caused by a driver who was unable to keep the control of his or her vehicle. A lot of factors can influence how the offense regarding DUI is being charged which include the BAC or blood alcohol concentration and other crimes that were done during the time frame of the same offense which is prior to their conviction of DUI and other circumstances.

People who have been arrested and convicted of driving under the influence will be charged of certain sanctions. DUI is known as a criminal offense and DUI violators will go through the same criminal trial. The trial includes a prosecutor who will attempt to make a particular person guilty of the crime. A convicted person will be facing number of penalties which is still dependent on the jurisdiction involved in the circumstances therein.

There are different criminal punishments for those people who have been convicted of driving under the influence but still differ from state to state. There are some states who are imposing penalties such as probation, jail time, court costs, fines, suspension of privileges in driving, drug and alcohol education programs or attending DUI classes, revocation of driving privileges and requirements for having an additional insurance (which is quite expensive) for DUI offenders. The penalties are still dependent on how serious the crime is and the criminal record of the convicted person. For people who have done multiple offense, they will no longer have the easier sanctions. They will be mandated to have several days in prison, have longer suspension of license and should attend longer classes on driving under the influence.
